NCsoft’s games are comprised, without limitation, of software code, programs, routines, subroutines, objects, files, data, characters (including but not limited to attributes comprising or associated with a character or Member account), graphics, sound effects, music, animation, video, text, content, layout, design and other information downloaded from and accessible through the Service (collectively, the "Game Content").
Members are permitted to make use of Game Content in noncommercial contexts, including in connection with the creation of noncommercial fan fiction and fan sites and using game audio and video for creating noncommercial media.
Members are prohibited, however, from reproducing, preparing derivative works based upon, distributing publicly performing, or transmitting the Game Content for commercial uses without the express written consent of NC Interactive. A “commercial use” by a Member would be any use for which a Member receives monetary value, including but not limited to payment of fees to the Member by others.
For clarification purposes only, a “derivative work based upon” Game Content is any work which is substantially similar, both in ideas and expression, to the Game Content. Similarity of ideas in the Game Content and derivative work concern similarities between things such as plot, theme, mood, setting, character traits, etc. Similarity of expression considers the total concept and feel of the Game Content and the derivative works. Thus, if someone knowledgeable of the Game Content is presented with a work not created by NC Interactive (or its related Game Content Providers) and such work is likely to bring to mind the Game Content, then it is likely that such work is a derivative work of the Game Content. Members are prohibited from engaging in commercial activities relating to any such derivative works.
For example, creating tee-shirts that depict in-game characters and selling them to others would be a prohibited commercial use of a derivative work. Charging a fee to others for the privilege of accessing a fan site created by a Member of an NCsoft game would be a prohibited commercial use of a derivative work. Providing copies to others of fan fiction created by a Member based on any NCsoft property for a fee would be prohibited commercial use of a derivative work. Authoring computer software for a game that includes characters created by a Member on NC Interactive’s servers, and selling such game to others for a fee would be a prohibited commercial use of a derivative work.
A simple rule of thumb is if the Member is receiving anything of value in exchange for a work created by the Member based upon, or related to any of the NCsoft line of games, it is likely to such use is an impressible commercial use of the exclusive rights held by NC Interactive (and its related Game Content Providers).
